References in these terms and conditions to “pause" (or "we", "us" or "our") refer to pause.
1. Access and use
All material available on the pause Site (including content available on our email and SMS services) (the "Content") belongs to pause or its licensors. pause or its licensors own all intellectual property rights (including copyright and database rights) in the Content and any selection or arrangement of the Content.
You may retrieve and display Content on a computer screen, PDA or mobile telephone, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk or on your mobile telephone (but not on any server or other storage device connected to a network) for your personal, non-commercial use.
You may not use the pause Site for any unlawful purpose. Except as expressly set out above, you may not reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive or in any way commercially exploit any of the Content.

You will be responsible for all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlement sums paid by us as a result of any settlement agreed by us arising out or in connection with: Any claim by a third party that the use of the pause Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice
Any claim by any third party that the use of the pause Site by you infringes that third party’s copyright or other intellectual property rights of whatever nature; and any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the pause site by you. You acknowledge that “pause" and the other pause sub-brands are registered and unregistered trade marks and that you may not use them without written permission from pause
2. Privacy policy and registration
If you provide pause Refreshments with an email address that will result in any emails or SMS messages sent you by pause being sent to you via a computer network or telephone operated or owned by a third party (e.g. your employer or college) then you warrant that you are entitled to receive those messages. You also agree that pause may refrain from sending messages to you without notifying you, even if you have subscribed to receive them, if we receive a request from a third party to stop sending emails or SMS messages to you.
3. Technical requirements and site security
The pause Site is best viewed using the Internet browsers IE5 or Netscape 6 (or later versions). Any older browser versions may work but users could have limited browsing experience.
4. pause’s liability
The pause Site is provided by pause without any warranties or guarantees. You must bear the risks associated with the use of the Internet. pause shall develop and operate the pause Site with reasonable skill and care and has reasonable security procedures in place. In particular pause shall not be liable to you for: Incompatibility of the pause Site with any of your equipment, software or telecommunications links Technical problems including errors or interruptions of the pause Site Unsuitability, unreliability or inaccuracy of the pause Site; or Inadequacy of the pause Site to meet your requirements. To the full extent allowed by applicable law, you agree that pause will not be liable to you for any losses which are not a direct consequence of your use of the pause Site (including loss of profits or loss of privacy or loss of or damage to data) or which arise as a result of your using the pause Site outside the scope of these Terms and conditions. Nothing in these Terms and conditions shall exclude pause’s liability for personal injury or death caused by its negligence or fraud.
5. Third party sites and services
The pause Site contains links to other Internet websites or online and mobile services provided by independent third parties ("Third Party Sites"), either directly or through frames. Third Party Sites may be co-branded with pause and so include pause’s trade mark. pause is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites. If you purchase products or services from a Third Party Site your contract for such products or services will be with the third party and not with pause. Our Privacy policy does not apply to Third Party Sites.
6. Choice of law and jurisdiction
These terms and conditions shall be governed by, and construed in accordance with, English law. To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.
7. General
You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect. If you breach these terms and conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these terms and conditions. pause shall not be responsible for any breach of these terms and conditions caused by circumstances beyond its control. Any person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any of these terms and conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act. The pause Site is owned and operated by pause, whose registered address is pause, Unit 1, Eastborough Court, Alliance Close, Attleborough Fields Industial Estate, Nuneaton, CV11 6SD. These terms and conditions were last updated on 27/03/2008 and replace all previous terms and conditions for the pause Site.
